Terms of Service for Horoscorpio

"Horoscorpio," "we," "our," and "us" mean Kudomos (ABN 15 384 058 395). "You" means the person using the app or website. By using Horoscorpio you agree to these Terms.
1. Agreement and eligibility
By downloading the app, creating an account, or using horoscorpio.com, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy (incorporated by reference). If you do not agree, do not use the service.
You must have capacity to enter a contract. Accounts are available only to people aged 16 or over, worldwide. This single minimum meets the Australian social-media minimum-age framework and every lower national minimum, including France's prohibition on under-15 access to social-network services.
You must give a truthful age signal. Your birth year is recorded once at registration and cannot be changed afterwards; age is computed conservatively (we assume your birthday has not yet passed in the current year). Circumventing the age gate is a material breach of these Terms.
2. What Horoscorpio is (and is not)
Horoscorpio is an astronomical aspect-timing and planetology instrument. It computes real planetary positions and aspect timings from cached Astronomy Engine ephemeris calculations and lets members contribute and explore a shared planetology corpus, form live "groups" from current sky geometry, and — with consent — engage other members.
Horoscorpio is not a fortune-telling, divination, or prediction service, and it does not provide professional advice. See the disclaimers in Section 7.
2a. The permission wall — consent architecture (immutable)
Horoscorpio is built on a permission wall: no one, of any age, can see profile information about a member without that member's invitation. Members appear to one another only as rank aliases until the member concerned takes an affirmative step (accepting a Challenge, extending an Invite, or Submitting access). Accordingly:
Consent. Data behind a permission wall cannot be harvested or accessed without unambiguous, affirmative consent from the individual it concerns. Consent is granted per counterpart and per group, is limited to the duration of the relevant 360° combination group unless renewed, and is revocable at any time with immediate effect.
This is an immutable design and legal position of the service: no feature, setting, integration, or administrative process overrides it, and any external integration (e.g. a linked social profile) only ever exposes a pointer the member expressly connected, to a counterpart the member expressly authorised.
2b. The Matrix — proximity resonance (opt-in)
The Matrix is an optional feature that displays and, with consent, composes members' quality-auras (a colour spectrum derived from keyword contributions). Your use of it is subject to the following, which sit within and do not diminish the permission wall in 2a:
- Specific consent, obtained at the feature. The Matrix is unavailable until you give affirmative, feature-specific consent at a prompt shown the first time you open it. That consent may be withdrawn at any time in Settings, which removes you from the shared pool; withdrawal never requires uninstalling the application.
- Aura only — never personal information or location. Through the Matrix, others perceive only your derived aura under an anonymous, auto-generated tag. Your name, contact details, and precise location are never disclosed through the Matrix. Identity moves only by the mutual consent mechanism in 2a.
- No bearing to a person. No compass, indicator, or feature of the Matrix will ever direct a member toward the precise location of another identifiable individual. Proximity, where offered, discloses only that a consenting member is nearby, anonymously, and connection occurs only by mutual affirmative act.
- Eligibility. The Matrix and any proximity/discovery feature are available only to members aged 16 or over, consistent with Section 1 and the age framework in our Privacy Policy.
3. Accounts
You are responsible for your account and for keeping your credentials secure. Provide accurate information; one account per person; notify us of any unauthorised use. We may refuse, reclaim, or reset accounts (including auto-generated handles) to protect the service or other users.
4. Your content and the corpus licence
You keep ownership of the words, ratings, and other content you contribute ("Contributions"). By contributing, you grant Kudomos a worldwide, royalty-free, irrevocable, perpetual licence to store, aggregate, reproduce, adapt, and display your Contributions as part of the planetology corpus and derived wordmaps. The licence is perpetual because the corpus is cumulative and timeless — a Contribution refines a planetary signature that recurs across history, and individual entries are de-identified at the aggregate layer.
Deleting an account removes its linkable Contributions and attribution, but does not unwind aggregate weights, ranks, classifications, canonical progressions, or derived wordmaps into which a Contribution has already been irreversibly assimilated without account attribution. Those corpus results cannot be used to restore the deleted account or identify its former member.
You warrant that your Contributions are yours to give, lawful, and non-infringing. We may moderate, refuse, reposition, or remove any Contribution. Contributions must be genuine — see the Acceptable Use Policy on corpus manipulation.
5. Acceptable use
Your use is governed by our Acceptable Use Policy. Violations may lead to the actions in Section 6.
6. Suspension and termination — our reserved rights
We reserve the right, at our sole discretion and with or without prior notice, to warn, rate-limit, restrict, suspend, or permanently terminate any account or access where we reasonably believe you have breached these Terms, the Acceptable Use Policy, or the law; where required to protect users, the service, or the integrity of the corpus and ratings; or where you circumvent the age gate, impersonate others, harass, or attempt to game the system.
Where practical we apply graduated action (warn → restrict → suspend → ban), but severe conduct (e.g. threats, illegal content, underage circumvention, coordinated manipulation) may result in immediate termination. On termination your licence to use the service ends; provisions that by nature survive (content licence in §4, IP in §8, disclaimers, liability, indemnity, governing law) continue. We may retain the minimum records needed to evidence and defend the decision, handle appeals, and meet legal obligations (see the Privacy Policy). To appeal, contact [email protected]. Termination for cause does not entitle you to a refund except where the Australian Consumer Law requires one.
7. Planetology disclaimers (please read)
- No divination; not professional advice. Horoscorpio provides astronomical data and a planetology framework. It does not predict future events and is not a substitute for professional financial, investment, legal, medical, psychological, relationship, or career advice. Nothing in the service is such advice.
- No reliance. You must not make financial, medical, legal, safety, or major life decisions in reliance on aspect timings, keyword canon, group matches, or "aura" readings. The service is provided for informational and experiential purposes.
- The canon is aggregated meaning, not a scientific claim. Canonical keywords represent the "Assessment of the Perfect Case by Real Use" — aggregated human association — not a representation that planets cause the qualities described.
- Groups and matching are not vetting or compatibility guarantees. Group formation reflects live sky geometry and contributions; it is not dating/relationship advice, background-checking, or identity verification (beyond optional platform sign-in). You are responsible for your own safety in any off-platform contact.
- Astronomical data "as is." Data is generated from open-source Astronomy Engine ephemeris calculations and cached ahead of time for runtime resilience. Legacy NASA/JPL-derived reservoirs may be used only where expressly labelled for validation or backfill. Astronomical data is provided without warranty of accuracy and must not be used for navigation, scientific, or safety-critical purposes.
8. Intellectual property
The Horoscorpio software, brand, holograph/visual system, and the planetology corpus are the intellectual property of Kudomos and are protected. The corpus is Horoscorpio's proprietary compilation: its selection, arrangement, classifications, aggregate weights and ranks, canonical progressions, derived wordmaps, and progression logic. This does not claim exclusive ownership of ordinary words, public-domain facts, or a contributor's underlying original expression; it protects the compiled canon and system created from them. We grant you a limited, revocable, non-transferable licence to use the service for personal, non-commercial purposes. You may not copy, scrape, extract, reconstruct, resell, or reverse-engineer the corpus or software.
9. Payments
- Web membership (horoscorpio.com) — the data services (Journals, keywords, the Directory and Planets data compartments) and the 360° combination Groups are offered by annual subscription processed by Stripe: 7 days free, then the annual regional fee, which is INCLUSIVE of any applicable tax (GST/VAT/sales tax is calculated by billing location and taken out of that amount, never added to it — the price displayed is the total price you pay). Pricing is regional — the base price is A$19.99 AUD per year, and the price and currency for the country or region you subscribe from (for example US$24.99, £29.99, €29.99) are always displayed at checkout before you pay. Renewals continue in the same currency at the price you subscribed at unless we notify you of a change before the renewal. A payment method is collected at signup; on day 8 the fee is charged automatically unless you opt out inside the trial (opting out inside the trial means nothing is charged). One free trial per person. Like all accounts, the data service requires you to be 16 or over; a payment method is collected to take payment and is not treated as proof of age.
- Cancellation & refunds (rest of world): you may cancel future renewals at any time; no refunds are given for the billing cycle already charged, except where the Australian Consumer Law or another non-excludable law requires one.
- Cancellation & refunds (EU / EEA / UK members): you have a 14-day statutory right of withdrawal from the day the subscription is taken out. Because the first 7 days are free, if you withdraw during days 8–14 you receive a pro-rata refund of the charged fee (deducting only the days of paid service used), with the corresponding VAT reversed and a credit note issued. From day 15 the statutory right lapses and the standard no-refund policy applies.
- Mobile app (horoscorpio.com) — sold directly by Kudomos on the Horoscorpio site as a one-time purchase, in addition to the web membership. Checkout is processed by Stripe; we receive purchase confirmation and the limited billing records needed to provide and account for the purchase, but never your full card details. Refunds follow these Terms and any refund terms shown at checkout, without limiting your non-excludable Australian Consumer Law rights.
- Nothing in this section limits consumer guarantees that cannot be excluded under the Australian Consumer Law.
10. Consumer guarantees, disclaimers, and liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law; nothing in these Terms limits those rights. Subject to that, and to the maximum extent permitted by law, the service is provided "as is" and "as available," without other warranties; and our aggregate liability arising from the service is limited, at our option, to resupplying the service or refunding the amount you paid for it (if any). We are not liable for indirect or consequential loss, or for decisions you make in reliance on the service (see Section 7).
11. Indemnity
You agree to indemnify Kudomos against claims, losses, and costs arising from your breach of these Terms or the Acceptable Use Policy, your Contributions, or your unlawful use of the service, except to the extent caused by us.
12. Governing law
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts. Nothing here removes rights you have under mandatory local consumer law.
13. Changes and contact
